July 8, 2022 on The Story: Under a new state law that became effective July 1, Oregon began adjudicating the pretrial release of criminal defendants based on their potential danger to the community more so than on their ability to pay bail. It’s a method meant to make the criminal justice system more just, breaking down traditional barriers for the poor and people of color while continuing to keep high-threat offenders off the streets. But the recent case of a man who allegedly directed a targeted and vicious attack against an Asian family on Portland’s Eastbank Esplanade, and his swift release from jail, underlines how there continue to be major pitfalls in our justice system that could endanger victims.
