Description
A judge at the ICE Detention center in Jena, Louisiana, told the government it has 24 hours to produce evidence against Mahmoud Khalil or the case is over.
Mahmoud Khalil sat calmly, with no signs of tension as Judge Comans and his attorney Marc Van Der Hout discussed who was representing Khalil in his immigration case and who would receive access to a WebX Video Conference that would provide both audio and video to those parties involved with the case. Van Der Hout, who is representing Khalil pro bono, appeared via that video conference along with other attorney’s representing Khalil. Khalil’s wife, Noor Abdalla, also joined the hearing by video conference.
In a rarely used move — DHS and the Trump administration moved to detain and deport Mahmoud Khalil under a provision of the Immigration and Nationality Act of 1952 -- claiming he presents a serious foreign policy consequence to the United States among other allegations lobbied against him.
Judge Comans told a DHS representative who was present in the court room — seated across from Khalil -- that DHS must present evidence by April 9th at 5 pm. Van der Hout will then confer that evidence with Khalil on April 10th. By April 11th, Judge Comans will hold a contested removability hearing in the case.
Glen Wasserstein of the Immigration Law Group, who does not represent Khalil, gave his perspective.
